By accessing, downloading, creating an account for, or using the Service, you agree to this Legal & Privacy document (the “Terms”). If you do not agree, do not use the Service.

We may provide notices to you electronically, including through the Service, email, or other reasonable means. You agree that electronic notices satisfy any legal notice requirement.

2. Eligibility

The Service is intended for adults only. You may access, download, or use the Service only if you meet all of the following conditions, and you represent and warrant that you do:
1. Age Requirement
You are at least 19 years old. If we learn or reasonably suspect you are under 19,we may immediately suspend or terminate your account and take steps to remove or restrict your information consistent with applicable law and safety obligations.
2. Legal Capacity and Authority
You have the legal capacity to enter into a binding agreement with Fractalism. You are not restricted from using the Service under applicable law, court order, or other legal obligation.
3. Personal, Non-Commercial Use
You will use the Service solely for personal, non-commercial purposes (dating, social connection, and related communications). You will not use the Service to advertise, solicit, promote, or conduct commercial activities without our written permission.
4. Compliance With Laws and These Terms
You will comply with applicable laws and these Terms at all times, including rules related to consent, harassment, privacy, and content sharing. You will not use the Service for any illegal, harmful, or abusive purpose.
5. Not a Safety Risk / No Serious Harm History
You represent that you are not required to register as a sex offender (or equivalent)in any jurisdiction and that you have not been convicted of crimes involving sexual violence, human trafficking, exploitation of minors, or other serious offenses that could reasonably pose a risk to other users. If this is not true, you must not use the Service.
6. No Impersonation / No Deceptive Harm
You will not impersonate another person or create deceptive identities for harmful purposes. You may choose what to disclose in a dating context, but you may not use the Service to scam, extort, threaten, blackmail, or materially mislead others in ways that endanger or defraud.
7. One Person, One Account (Unless We Allow Otherwise)
Your account is for your personal use. You may not share, sell, transfer, or allow others to use your account. We may limit accounts per person/device and take action against duplicate, shared, or automated accounts.
8. Verification and Safety Checks
To protect the community, we may use verification measures and safety checks, including requesting additional information, using device/behavioral signals, or asking for proof of age or identity. If you refuse requested verification or provide misleading information, we may restrict features, suspend, or terminate your account.
9. No Guarantee About Others
We do not conduct full background checks and cannot guarantee the identity, intent, or conduct of users. You are responsible for your interactions and for using judgment and caution, especially when meeting in person.
10. Geographic Availability
The Service may not be available everywhere, and we may restrict or discontinue access in any region. You are responsible for ensuring your use is lawful where you live and where you access the Service.

3. Your Account

You agree to provide accurate information and keep it updated. You must maintain the confidentiality of your credentials and promptly notify us of any unauthorized access. You are responsible for all activities that occur under your account. We may disable accounts that appear to be automated, fraudulent, abusive, or used in violation of these Terms.

4. How LoveHalfBlind Works (Conversation-First, “Half-Blind” Design)

LoveHalfBlind is designed to encourage meaningful conversation and reduce snap judgments. Certain profile elements (including photos or other identity cues) may be limited or revealed over time based on product design (the “Half-Blind Experience”).
You understand and agree that:
a) reveal timing, what is shown, and which features exist may change;
b) experiences may vary by region, device, settings, safety signals, experiments, or subscription tier;
c) we do not guarantee matches, replies, compatibility, or outcomes;
d) you will not attempt to circumvent the Half-Blind Experience or pressure others to bypass it (including coercing someone to reveal private contact info, location, or identity).

5. Community Standards (Rules of Conduct)

You must use the Service safely and respectfully. You must not:
a) harass, threaten, bully, stalk, intimidate, or defame others;
b) post, share, request, or distribute content involving minors, or any content that is sexually exploitative, non-consensual, or illegal;
c) share non-consensual intimate images, sexually explicit content without consent, or engage in sexual coercion;
d) impersonate others, misrepresent identity for harmful purposes, or create deceptive profiles to scam or manipulate;
e) promote hate, discrimination, or violence, or threaten harm;
f) solicit money, gifts, loans, “sugar” arrangements, or run scams/fraud;
g) spam, advertise, or use the Service for commercial promotions without permission;
h) share private or confidential information about others without consent (including doxxing);
i) scrape, harvest, or collect data from the Service, including user information;
j) send malware, attempt unauthorized access, reverse engineer, or interfere with the Service;
k) bypass safety, moderation, or technical controls (including re-creating banned accounts);
l) pressure or manipulate others to reveal personal details against their preferences;
m) encourage unsafe meetups or otherwise endanger others.
We may remove content, restrict features, reduce visibility, or suspend/terminate accounts to enforce these Terms and protect the community.

6. Safety Tools, Reporting, and Enforcement

The Service may include reporting, blocking, and moderation tools. You agree to use reporting tools honestly and not to submit false or abusive reports.
We reserve the right (but do not assume an obligation) to monitor, review, and moderate content and behavior; investigate complaints; and take enforcement actions including warnings, content removal, feature restrictions, suspensions, or permanent bans. We may take action based on credible safety risk signals, including conduct linked to Service usage even if some behavior occurs off-platform and is relevant to user safety.

7. User Content

“User Content” includes your profile, photos, messages, prompts, and anything you submit. You are responsible for your User Content and your interactions. You represent and warrant that:
a) you own or have rights to all User Content you provide;
b) your User Content does not violate laws or third-party rights;
c) your User Content is not misleading, abusive, illegal, or harmful.
You understand that other users may screenshot or share content you send. We cannot guarantee that content will remain private once shared with other users. Do not share sensitive information you would not want disclosed.

8. License to Operate the Service

To operate and improve the Service, you grant Fractalism a non-exclusive, worldwide, royalty-free, sublicensable (to service providers), and transferable license to host, store, reproduce, process, adapt (for formatting, compatibility, and safety), display, and distribute your User Content as necessary to:
a) provide the Service (matching, messaging, profile display, the Half-Blind Experience);
b) maintain safety and integrity (moderation, fraud prevention, enforcement);
c) provide customer support;
d) improve and develop features;
e) comply with legal obligations.
This license generally ends when you delete your account, except where retention is required or permitted for legal compliance, safety, fraud prevention, and dispute resolution.

9. Feedback

If you submit feedback, suggestions, or ideas, you agree we may use them without restriction or compensation to you.

10. Prohibited Technical Uses

You must not use bots, scripts, scrapers, automation, or other unauthorized means to access or interact with the Service. You must not circumvent access controls, rate limits, or security features. You must not copy, modify, or create derivative works from the Service except as permitted by law. You must not use the Service to build competing products using our data, design, or user base.
We may implement technical measures to detect and prevent prohibited activity.

11. Purchases, Subscriptions, and Billing

The Service may offer paid features (subscriptions, upgrades, boosts, premium access). Pricing, features, and availability may change.
App Store Purchases: If you purchase through Apple App Store or Google Play, billing, cancellations, and refunds are handled by the platform and governed by its terms and your platform settings.
Direct Purchases (if offered): Any direct billing terms will be shown at checkout.
Unless required by law or platform policy, purchases are generally non-refundable. If you believe you were charged in error, contact support.

12. Promotions and Trials

We may offer promotions, trials, or discount codes, subject to additional terms disclosed at the time of the offer. We may modify or end promotions at any time.

13. Privacy Policy

We collect and use information to provide the Service, keep users safe, and comply with law. We aim to follow applicable Canadian privacy principles, including transparency, purpose limitation, and reasonable safeguards.
13.1 Information We Collect
Depending on how you use the Service, we may collect:
a) Account information: email/phone, account identifiers, login and authentication data, age confirmation;
b) Profile information: photos, bio, prompts, preferences, and other details you choose to provide;
c) Messages and interactions: messages you send/receive, matches, likes, blocks, reports, and related metadata necessary to operate the Service and support safety and moderation;
d) Device and usage information: device identifiers, IP address, app events, analytics signals, crash logs, language settings, approximate location derived from IP;
e) Safety and integrity information: reports, moderation outcomes, suspected spam/scam signals, and related investigation notes/metadata;
f) Payment information: if you purchase paid features, purchases may be processed by Apple/Google or another provider; we typically receive transaction confirmations and limited billing metadata rather than your full card details (depending on your purchase method).
We do not require you to provide sensitive personal data to use core functions. If you choose to share sensitive information, you do so at your discretion.
13.2 How We Use Information
We use information to:
a) operate the Service (account access, matching, messaging, the Half-Blind Experience);
b) personalize and improve the experience;
c) detect and prevent fraud, scams, and abuse;
d) moderate content and enforce rules;
e) provide customer support;
f) measure performance, reliability, and product quality;
g) comply with legal obligations and respond to lawful requests.
13.3 How We Share Information
We may share information:
a) With service providers who help us operate the Service (hosting, analytics, security, customer support tooling, communications, and payment processing) under contractual safeguards;
b) With other users as part of the Service (your profile details you choose to display, and your messages to recipients);
c) For legal and safety reasons where required by law or where reasonably necessary to protect users, the public, or the integrity of the Service;
d) In business transfers (merger, acquisition, restructuring, asset sale) subject to appropriate protections.
We do not publish your private contact details unless you choose to include them in your profile or messages.
13.4 Data Retention and Deletion
You may request account deletion. After deletion, we will remove or anonymize information when reasonably possible, subject to:
a) legal requirements;
b) safety and integrity needs (fraud prevention, enforcement history, blocking lists);
c) dispute resolution and audit needs.
Retention periods may vary by data type and purpose.
13.5 Security
We use reasonable administrative, technical, and organizational measures designed to protect your information. No system is perfectly secure; protect your credentials and be cautious about what you share.
13.6 Cross-Border ProcessingYour information may be processed in Canada or other countries where we or our service providers operate. Those jurisdictions may have different data protection laws. We take reasonable steps to implement appropriate protections through contractual and technical measures.
13.7 Your Choices and Requests
Depending on Service features, you may be able to:
a) access and update your profile;
b) control certain visibility settings;
c) block and report users;
d) request deletion;
e) contact us for privacy requests at privacy@lovehalfblind.com.

14. Cookies and Tracking (Website)

Our website may use cookies and similar technologies for:
a) basic functionality and security;
b) analytics and performance;
c) remembering preferences.
You can manage cookies through your browser settings. Disabling cookies may affect site functionality.

15. Intellectual Property

The Service, including software, branding, design, and all related intellectual property (excluding your User Content), is owned by Fractalism or its licensors and protected by applicable laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except where permitted by law.

16. Third-Party Services

The Service may link to or integrate third-party services (including app stores, analytics, or payment providers). Those services are governed by their own terms and privacy practices.
We are not responsible for third-party services outside our control.

17. Copyright and Takedown Requests

If you believe content on the Service infringes your rights, contact legal@lovehalfblind.com with enough information to identify the content and explain your claim. We may remove content and take appropriate action.

18. Termination, Suspension, and Account Deletion

You may stop using the Service at any time. We may suspend or terminate your access if we believe you violated these Terms, created safety risk, engaged in fraud, or undermined platform integrity. We may retain certain information after termination or deletion as described in the Privacy Policy.

19. Disclaimers (No Guarantees)

The Service is provided “as is” and “as available.” We do not guarantee:
a) uninterrupted or error-free operation;
b) that any user is who they claim to be;
c) that you will obtain matches or desired outcomes.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Fractalism Solutions Inc. will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service or your interactions with other users.
Where liability cannot be excluded, it will be limited to the maximum extent permitted by law.

21. Your Responsibility and Indemnity

You agree to defend, indemnify, and hold harmless Fractalism Solutions Inc. from and against claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
a) your use of the Service;
b) your User Content;
c) your violation of these Terms;
d) your violation of any law or third-party rights.

22. Governing Law and Venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Except where prohibited by law, you agree that disputes arising from or relating to these Terms or the Service will be brought in the courts located in Toronto, Ontario, and you consent to their jurisdiction.

23. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the Service or other reasonable means. Continued use after changes take effect means you accept the updated Terms.

24. Miscellaneous

a) Entire Agreement: These Terms are the entire agreement between you and Fractalism regarding the Service and supersede prior agreements.
b) Severability: If any part is found unenforceable, the remainder remains in effect. c) No Waiver: Failure to enforce a provision is not a waiver.
d) Assignment: You may not assign your rights under these Terms without our consent. We may assign these Terms in connection with a business transaction.
e) Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
